Kevin Gutzman, J.D., Ph.D. is associate professor of American history at Western Connecticut State University. Professor Gutzman joined us tonight to talk about his fascinating book, The Politically Incorrect Guide to the Constitution.
The Constitution of the United States created a representative republic marked by federalism and the separation of powers. Yet numerous federal judges–led by the Supreme Court–have used the Constitution as a blank check to substitute their own views on hot-button issues such as abortion, capital punishment, and samesex marriage for perfectly constitutional laws enacted by We the People through our elected representatives.
Now, The Politically Incorrect Guide(tm) to the Constitution shows that there is very little relationship between the Constitution as ratified by the thirteen original states more than two centuries ago and the “constitutional law” imposed upon us since then. Instead of the system of state-level decision makers and elected officials the Constitution was intended to create, judges have given us a highly centralized system in which bureaucrats and appointed–not elected–officials make most of the important policies.

Bruce McQuain from QandO joined us for another edition of Someone You Should Know. The Someone You Should Know radio collaboration began as an extension of Matt Burden’s series at Blackfive. Thanks to Matt, Bruce is now on board and we are lucky to have him as part of the show.
Tonight, Bruce told us an amazing story about about an amazing Marine, Silver Star rceipient SGT Leandro Baptista, USMC,
In terms used to describe generations of heroes of American wars, the citation recounted how on April 7, 2004, 60 insurgents in fortified positions ambushed Baptista’s 25-man platoon while they rode in a five-vehicle convoy just south of Fallujah.
With six men wounded and two vehicles out of action, Baptista “sprinted across a shallow canal, climbed a 10-foot berm, and charged towards the enemy.”
Under fire, he knocked out one gun emplacement and grabbed three other Marines to help continue his charge.
After disarming an improvised bomb that threatened backup forces, Baptista split his men up, and the ad hoc team charged a group of 11 insurgents from two angles. Baptista killed at least four of them himself “at close range,” while his team attacked the other seven, the citation said.
Marines at the ceremony said at least one Marine was killed during the 30-minute ambush and firefight.
The citation concluded that by his “bold leadership, wise judgement and complete dedication to duty” Baptista upheld the “highest traditions of the Marine Corps.”
After pinning the heavy star on Baptista’s shirt pocket during the ceremony Friday, Maj. Gen. Richard Natonski, the 1st Marine Division’s commanding general, said that hearing the events of that day recounted “brings chills to my spine.”

The question now is whether Sen. Thompson will do what he has not yet done: Take the advantages he is given by his intelligence, his principles, his political skills and this endorsement and make the best use of them.
As the primaries and debates speed by, we would like to see Sen. Thompson continue to invigorate his campaign to carry him successfully through Tsunami Tuesday and to nomination at the Republican convention.

What’s great about this is that both candidates were in top form. Fred went hard after Huckabee, as he has to in South Carolina, in a way that grabbed conservatives’ attention, and Huckabee responded graciously, and quite disarmingly. One of the those rare moments that worked for both of them.
Who put the vitamins in Fred Thompson’s oatmeal? We have waited for Thompson to show up on the campaign trail, and tonight he finally did. He had energy, focus, a command of detail, and a willingness to finally engage with the other candidates on the stage. He took almost everyone else aback, and seized momentum that he only occasionally relinquished.
I think Fred Thompson accomplished what he intended to do in last night’s debate. Now we have to wait and see if his plan worked.

U.S. general: Anbar ready for Iraqi control
WASHINGTON (AP) — Iraq’s western province of Anbar, origin of the Sunni Arab insurgency that arose in the early months of U.S. occupation, will be returned to Iraqi control in March, a senior U.S. general said Thursday.
Thus far, nine of 18 Iraqi provinces have reverted to Iraqi control, most recently the southern province of Basra in December. The process has gone substantially slower than the Bush administration once hoped, mainly because of obstacles to developing sufficient Iraqi police and army forces. But Defense Secretary Robert Gates said Thursday that he expects the process to continue.Marine Maj. Gen. Walter E. Gaskin, commander of the roughly 35,000 Marine and Army forces in Anbar, said levels of violence have dropped so significantly — coupled with the growth and development of Iraqi security forces in the province — that Anbar is ready to be handed back to the Iraqis.
Prior to Christmas, I had the opportunity to pose a very direct question on the Howie Carr Show about why former governor Romney ordered his Department of Health to change the marriage certificates from “husband” and “wife” to “partner A” and “partner B” without any accompanying legal statute and why he ordered his Justices of the Peace to solemnize and perform same sex marriage ceremonies or resign again without any accompanying legal statute which is illegal. Under the Massachusetts Constitution which John Adams authored:
“the people of the Commonwealth are not controllable by any other laws than those to which their constitutional representative body have given their consent.” (Article X of the Massachusetts Constitution)
Since there was no “court order” (merely a declaratory opionion without consequential relief) and the people via their elected represetatives never provided their “consent” for changing the current marriage statute chap 207 to allow for “same sex marriage” Romney had no legal authority to issue same sex marriage certificates. (the court didn’t even have the constitutional jurisdiction in the first place to even hear the case in and of itself an impeachable offense.)
I also asked him if it may have had anything to do with his promise he had made in a secret meeting with the Log Cabin Republicans in 2002 not to oppose “same sex marriage” in Massachusetts in order to get their endorsement for governor. He didn’t deny this meeting or said promise.
And he very furtively ducked my question about ordering his Department of Health to change the marriage certificates.

Mass Resistance has posted the audio and transcript of a call that took place on the air during the Howie Carr show on the afternoon of December 21 on WRKO in Boston.
The caller was Gregg Jackson, who is co-host of Pundit Review Radio on Sunday evenings on WRKO and is co-proprietor at the Pundit Review blog. Howie Carr’s guest was Objectively Unfit Mitt Romney, who in the course of answering Jackson’s question, showed exactly why he is, indeed, objectively unfit.
Keep in mind that Gregg is the author of “Conservative Comebacks to Liberal Lies,†a book that has earned rave reviews from the likes of Thomas Sowell (â€political and media spin are shot to pieces by hard factsâ€) and David Limbaugh (â€There is not a better one-stop-shop item to refute with evidence and examples the liberal lies.â€).
The former Massachusetts governor, according to this debate footage (first 30 seconds of so at linked video), wants to: “….. bring together the same coalition that Ronald Reagan put together, conservatives fiscally, conservatives from a military standpoint, and conservatives socially,†and says that “….. I was a conservative Republican in a very Democrat state.â€
Let’s see how Mr. Coalition-Building Conservative handled perfectly legitimate questions from (sorry Gregg, I’m going to make you blush) one of the rising stars of conservative punditry (bolds are mine; explanations of footnoted items are at the end of this post):
The fact that Romney lied about the court “legalizing same sex marriage” and that he was merely “following the law” when there is no such law is one of the primary reasons I have opposed his candidacy so vigorously. Romney, not the courts, gave Massachusetts “same sex marriage” and in the process shredded the oldest functioning constitution in the world. This alone I believe disqualifies him from the presidency.

Democrats: Iraqi Troop Buildup a Failure
WASHINGTON — One year after President Bush announced his politically unpopular plan to send thousands more troops to Iraq, Democrats are struggling to counter the administration’s argument that the buildup succeeded.
Democrats are so wedded to the notion of defeat for George Bush in Iraq, that they cannot even admit the obvious. The troop surge, by every measure, has been a resounding success. Sure, individual Democrats have seen the success for themselves and acknowledged it. The party base and leaders, that’s another story. Victor Davis Hanson told us Sunday evening that what Gen. Petreaus has done is one of the greatest turnarounds in American military history.
Today, the so-called leaders of the Democrat Party look away from great American success in Iraq to search for petty political points. If they can’t feel good about the success of the surge, is there anything this country does that they do feel good about?
They went “all in” hoping for a bitter Iraq defeat, and they can barely hide their resentment at the turnaround. Before, it was the violence. Now, it is political progress they cite. Is there any doubt that the goalposts will change yet again, always looking for the angle to portray our country, and her accomplishments, in the most negative light?
Who feels good about supporting a political party that sees no good in their own country’s achievements? Who feels good about a party more motivated by the prospect of defeat than the prospect of victory?
Listen to them talk about the economy, or America’s standing in the world. Democrats are a negative, miserable lot. They are the party of “no we can’t” not “yes we can”. Sorry Barack, but its true.
The essential character trait of the modern day Democrat is pessimism about America’s future. Good luck with that this November.

Every American should feel a debt of gratitude to Gen. Petraeus and the great American troops fighting under him for us. This gratitude is due not simply for the extraordinary progress they have accomplished in Iraq, but for what they have taught us about ourselves.
If the mismanagement of the Iraq war from 2003 to 2006 exposed our government’s capacity for incompetence, Gen. Petraeus’ leadership this past year, and the conduct of the troops under his command, have reminded us of our capacity for the wisdom, the courage and the leadership that has always rallied our nation to greatness.
As Americans, we have repeatedly done what others said was impossible. Gen. Petraeus and his troops are doing that again in Iraq today.
The war for Iraq is not over. The gains we have made can be lost. But thanks to the courage of our troops, the skill and intellect of their battlefield commander, and the steadfastness of our commander in chief, we have at last begun to see the contours of what must remain our objective in this long, hard and absolutely necessary war — victory.
